  Bicycle – Pedestrian Accidents

If you have been struck by a motor vehicle while walking, skating or riding a bicycle because of the negligence of the driver, we want you to know you are entitled to be fully compensated for your injuries and damages.

If your bicycle has been damaged, the insurance carrier for the car that struck you must compensate you. You are entitled to the fair market value of your bicycle at the time of the accident. The insurance carrier will determine the approximate value of your bike before making a settlement offer. It is a good idea to obtain a second opinion from someone who sells and services bicycles like yours before the insurance carrier makes its offer to you. In this way you can determine whether or not the insurance adjuster is treating you fairly.

If you have been struck by a motor vehicle while walking, skating or riding a bicycle, the law considers you a pedestrian. Because you were injured by a motor vehicle, your medical bills and lost wages MUST be submitted to your own auto insurance carrier for payment.

Essentially, because your injuries were caused by a motor vehicle, Personal Injury Protection insurance (PIP) is the primary source of insurance for payment of your medical bills and lost wages. Our website provides information that may be useful to you. You may review this information by accessing the motor vehicle accident section. Please feel free to review that information at your convenience as it may answer many of the questions you have concerning payment of your medical bills and lost wages through PIP.

You should be aware of an important exception in the law that may benefit you if you were struck by a motor vehicle as a pedestrian but neither owned nor resided with a relative who owned a motor vehicle at the time of the accident. In such a case, you are entitled to have your medical bills and lost wages paid by the insurance carrier for the person who struck you under their PIP coverage. If you incurred medical bills and/or lost wages due to being struck by a motor vehicle, you may be entitled to PIP benefits from the insurer for the motorist even if the accident was your fault!

We want you to know if you were injured due to the negligence of a motorist, you are entitled to be fully compensated for your medical bills and lost wages from the insurance carrier covering the vehicle that struck you. Entitlement to damages for pain and suffering however, depends on your ability to prove that you suffered a permanent injury as a result of the accident. Again, please review the information contained in the motor vehicle accident section of our web site for more specific information on this important topic.

All personal injury cases seek to address a number of complicated, interconnected issues. It is important to contact a lawyer who has the knowledge, experience and skill in cases like yours to protect your right to full compensation.
